Pilot Agreement

This Agreement is between SiaMoon Co. LTD, trading as LandWise (“LandWise”, “we”), of 50/2 Moo 6, Koh Phangan, Surat Thani, Thailand, and you, the drone pilot who registers for and flies missions through the LandWise Pilot Network (“you”, “the Pilot”). By submitting your pilot application you confirm you have read, understood and agree to be bound by this Agreement.

You are an independent contractor, not an employee, partner or agent of LandWise. Nothing here creates an employment or joint-venture relationship. You decide whether to accept any given mission, you supply your own drone and equipment, and you are responsible for your own taxes, social-security contributions and any business registration required under Thai law.

You are solely responsible for operating lawfully and safely on every mission. This includes, without limitation:

• holding all registrations and permits required by the Civil Aviation Authority of Thailand (CAAT) and any other authority — including drone registration for aircraft over 2 kg and insurance where mandated;
• respecting no-fly zones (airports, military areas, national parks) and obtaining any permission required for commercial flight;
• obtaining landowner consent before flying over or on private property;
• operating the aircraft safely, in airworthy condition, within visual line of sight and within the limits of weather and your competence; and
• complying with all local laws, including data-protection and privacy laws, while capturing imagery.

You are responsible for maintaining your own valid drone third-party liability insurance appropriate to commercial operations, and for any equipment cover you want. LandWise strongly recommends it and may require proof before assigning missions. LandWise does not insure you, your aircraft, or third parties against loss, damage or injury arising from your operations.

Each mission is a standardised LandWise brief (flight pattern, altitude, overlap and capture parameters). You agree to fly the mission as specified and to upload the resulting data through the platform. On acceptance and payment, all imagery, flight logs and derived data you deliver for a mission become the property of LandWise and its client, and you assign to LandWise all rights in that data. You will keep mission briefs, client identities and any LandWise information confidential, and will not reuse, publish or resell mission data.

You are providing aerial photography and photogrammetry data collection. You are not performing a certified cadastral or legal boundary survey, and nothing you deliver is represented as “survey-grade” or as establishing legal boundaries, unless a specific mission expressly engages you for a certified survey you are qualified and licensed to provide. LandWise is responsible for processing, interpreting and presenting the data to its clients.

Each mission shows a fixed fee. After you submit your data and LandWise approves it, LandWise pays the stated fee to the payout method on your profile (e.g. PromptPay, bank transfer or Wise). LandWise may withhold or reduce payment for data that does not meet the mission brief, is incomplete, or was captured in breach of this Agreement. You are responsible for any taxes due on your earnings.

You are liable for your own acts and omissions and for any loss, damage, injury, claim, fine or penalty arising from your operation of the drone or your breach of this Agreement. You agree to indemnify and hold LandWise (and SiaMoon Co. LTD, its directors and staff) harmless against any such claims, including third-party claims for property damage or personal injury. To the maximum extent permitted by law, LandWise’s total liability to you in connection with this Agreement is limited to the fees payable for the mission(s) giving rise to the claim, and LandWise is not liable for indirect or consequential loss.

Either party may end this relationship at any time. LandWise may suspend or remove your account — and decline or reverse payment — if you breach this Agreement, operate unsafely or unlawfully, or submit fraudulent or substandard data. Confidentiality, data assignment, and liability/indemnity survive termination.

This Agreement is governed by the laws of Thailand, and the courts of Thailand have jurisdiction over any dispute. If any provision is found unenforceable, the rest remains in effect.
